CU Joins Amicus Brief in Talbott v. USA (Transgender Military Service)
On Tuesday, September 30, Citizens United joined retired Army Lt. General Michael T. Flynn and several conservative organizations in filing an amicus brief with the U.S. Court of Appeals for the D.C. Circuit urging the court to overturn an order of the U.S. District Court for the District of Columbia that preliminarily blocks the War Department from implementing a policy that generally prohibits so-called “transgender” individuals from serving in the U.S. military. The brief makes four main arguments: (1) The District Court improperly disregarded all the reasons offered in support of the policy, (2) the lower court’s injunction violated separation of powers, (3) the district court’s order is not consistent with U.S. Supreme Court precedent, and (4) the lower court’s order disregarded the problems associated with “gender dysphoria,” which is the medical term used to refer to a person who identifies as “transgender.”
