CU Amicus Brief – America First Legal Foundation v. U.S. Department of Agriculture (Presidential Communications Privilege)

Citizens United filed an amicus brief on December 11, 2023 in America First Legal Foundation v. U.S. Department of Agriculture, et al.  The case involves the Freedom of Information Act, presidential communications privilege, and the Biden Administration’s shameful lack of transparency. The FOIA requests have to do with Joe Biden’s controversial voting Executive Order that politicizes the federal workforce and amounts to an illegal taxpayer-funded Democrat get out the vote operation. CU is asking the U.S Court of Appeals for the District of Columbia to reverse the District Court’s decision in favor of the Biden Administration that keeps the records secret. CU filed this brief partly because we are currently involved in our own FOIA litigation that seeks similar records pertaining to the Biden EO in question.
