CU And CUF Join Amicus Brief In Mullin v. National TPS Alliance (Temporary Protected Status)

On August 12, Citizens United and Citizens United Foundation joined forces with two other conservative groups in filing an amicus brief urging the Supreme Court to order dismissal of a challenge to the Department of Homeland Security’s decision to terminate Temporary Protected Status for Venezuelan and Haitian nationals residing in the U.S. under a Biden Administration extension of that program. The brief, filed in Mullin v. National TPS Alliance, asks the Court to not only grant the Trump Administration’s petition to hear the case, but to also summarily vacate the lower court’s ruling invalidating the Trump Administration’s cancelation of the program and direct the lower courts to dismiss the underlying legal challenge.  “These amici urge that the Ninth Circuit should be denied any opportunity to repeat its history of “narrowing from below,” and thus, these amici believe the proper course is not just to remand the case for reconsideration in light of Mullin v. Doe, but rather to order the lower courts to dismiss the case forthwith.”
