CU Joins Amicus Brief in Trump v. CASA
On Friday, March 28, 2025, several conservative organizations, including Citizens United, banded together, to file an amicus brief urging the U.S. Supreme Court to grant President Trump’s request to stay a series of lower court decisions barring the federal government from implementing the President’s executive order denying so-called “birthright citizenship” to the offspring of persons who enter the United States illegally or who have no lawful permanent residence in the country. The brief cites historical authorities on the meaning of the phrase “subject to the jurisdiction thereof” in the 14th Amendment’s citizenship clause to show that the Framer’s of the amendment never intended it to bestow U.S. citizenship on foreigners or aliens who happens to be physically present in the United States at the time of his or her birth. Instead, the phrase limits citizenship based on birth to only those individuals who also have a “permanent allegiance” to this country.
