Politico: Would campaign finance transparency result in donor bullying?
At the founding of this great country, Alexander Hamilton, James Madison and John Jay wrote the Federalist Papers in secret because they felt reprisals could harm them, their families, and their businesses. If those patriots had instead been silent over two hundred years ago, then our Republic might not be standing right now. In Citizens United v. FEC, Justice Clarence Thomas warned of the potential for threats and reprisals inherent in the mandatory disclosure of donors’ names. Unfortunately, this isn’t some hypothetical or law school case study – it’s a sad reality we’ve seen play out far too often.
