Politco: Letter to the editor – DISCLOSE Act not the answer
Citizens United fights in defense of the First Amendment by CU President, David N. Bossie:
In his Sept. 17 op-ed, “Secret Funds Flow into Races,” Fred Wertheimer alleges that “secret money has returned to U.S. politics” and argues that the DISCLOSE Act is the solution. Unfortunately, the deceptively named DISCLOSE Act has little to do with transparency in elections. In reality is an attempt to chill speech. Sen. Chuck Schumer (D-N.Y.) revealed the effect of the DISCLOSE Act on political advertisements: “There’ll be many fewer of them.”
Wertheimer has been an advocate for campaign finance restrictions for some time. He has seen the legislative process that delivered pervious campaign finance legislation, like the Bipartisan Campaign Reform Act of 2002 (“BCRA”). BCRA was not forced through the legislative process overnight. It was developed in an open and transparent fashion and drew support across party lines.
